What does Estate Claims do?

Estate Claims specializes in finding hidden unclaimed funds and helping the righful owners with recovery of the money. We use proven investigative techniques to locate these funds and then determine who the correct claimants are. Without Estate Claims on their side, many rightful owners of these unclaimed funds would be overlooked and ultimately deprived of their lawful claim.

How Can I know this is legitimate?

We understand and respect your concern and have implemented a variety of business practices to safeguard your trust in us. First, we will disclose to you the total amount of money being held and what your portion will be before you are asked to move forward. Secondly, we NEVER ask you for ANY payment to begin the recovery process. In fact, we will PAY YOU a good-faith CASH payment toward your final settlement the same day we receive the completed forms needed from you. If we are unsuccesful recovering the funds - for any reason - you keep the cash payment with no strings attached. Thirdly, we use attorneys for recovery of the funds so you can be confident that all monies are handled properly and according to our agreement with you. Your trust and confidence in us is paramount to the success of what we do.

Why Should I have Estate Claims Recover funds for me?

Estate Funds has located unclaimed funds you likely would never have known about if we did not contact you. When we take on your claim, all the investigative research and related work is completed for you, guaranteeing accuracy, efficiency and a lack of wasted time, effort and money. Our fees are payable only on a successful outcome when the funds are distributed. If there is no recovery, there is absolutely no financial obligation to compensate us anything. The risk is entirely ours.

What happens after I complete the necessary forms?

There is very little required from you beyond authorizing Estate Claims to initiate your claim. We will need a signed agreement from you and the attorney will need a PoA to make a claim on your behalf. A copy of some vital records such as a birth certificate or your driver’s license will also be required to prove your identity. We will let you know exactly what is needed to prove your entitlement to the court and help you gather those documents, if needed.

Upon receiving your signed agreement to proceed, our work at Estate Funds is just beginning. We will conduct additional research, meet with attorneys, compile necessary documentation and evidence (certified birth/death/marriage records, declarations, or other items) for use as court exhibits, where needed, so a judicial determination of ownership can be made. If necessary, we will attend court hearings and provide expert testimony to verify our findings.

Your Estate Funds representative will keep you informed as the case progresses until the final accounting is issued. When the court is satisfied that we have sufficiently proved your claim, you will be mailed a check that represents your share of the claim. The sooner we receive your agreement back, the sooner we can go to work to obtain your share.

How much of my time will this take?

A few signatures and a photocopy or two is usually all that is required of you. Estate Claims will handle records/document retrieval, research, monitoring, and paying attention to all the numerous details necessary to prove your entitlement.

what is the cost of your services?

We make the process risk-free by offering our services on a contingency fee or “success or no cost” basis. This means that in the event that no distribution occurs, you owe nothing to Estate Funds, or to the professionals engaged to perform services on your behalf. The amount we retain as payment varies and is based on the difficulty and expenses (including legal, attorney, professional, recording, etc.) we anticipate will be involved in the recovery of the funds. We will make you the best offer we can, which will be a percentage of the total amount recovered. This amount will be in the agreement.

The advantages of the contingency fee approach include: 

  • No hidden charges or out-of-pocket expenses
  • No risk of potentially indebting any of the parties involved
  • You do not spend any of your money to conduct difficult or costly research
  • It creates a higher incentive to complete the research as efficiently, thoroughly, and as quickly as possible
  • It allows access to justice for those without financial means
  • If efforts are unsuccessful, there is no charge to you
  • You keep any monies we paid you upon completion of the necessary paperwork should the claim be denied for any reason

How long does this process take?

The process can be complex and unpredictable. While we can’t promise exactly how long it will take to settle your claim, it is our experience that it may take as little as 6 weeks for a very straight forward claim and as long as 24 months, or more, for a complicated probate process involving multiple claimants. Since we are not compensated until the funds are distributed, we will do everything possible on our end to expedite your claim.

There are a number of factors that can affect the process. Here are a few:

  • More than one rightful owner/claimant/beneficiary
  • Judgments and/or liens against the original owner(s) and/or claimant(s)
  • Disputes between claimants on the validity of a will or how assets should be distributed if the original owner is deceased
  • Efficiency of the authority holding the funds in reviewing and paying out the funds

Despite the possibility of these and other complications, Estate Claims and our attorneys are diligent in finding ways to overcome almost every obstacle. When we take your claim, we commit to doing all that we can to recover the maximum amount of funds possible for you.

what happens if i do nothing?

If we do not hear from you, or you choose not to proceed with the claim, we will attempt to locate any/all other creditors or potential claimants and work with them. In most jurisdictions, state laws mandate that, after a period of time, if you do nothing, the funds you may be lawfully entitled to receive will be turned over to the state as escheated funds, or the unclaimed funds may be distributed to creditors or other claimants known or presented to the court. There are also statutes of limitation, cut-off dates and strict deadlines. Once deadlines pass or others have made claims, your position may be diminished, or worse yet, lost forever and lawfully irretrievable. So we may be sure your interests are adequately represented and protected, simply return our agreement as soon as possible to avoid any possible roadblocks or delays. The time and legal costs to claim these funds at a later date may be more significant the longer you wait to act - if it is even a possibility at that time.
